中国式法治现代化是在中国式现代化范式下形成的标识性概念。法治、中国式、现代化三个关键词的相互关系，深蕴着中国式法治现代化概念的法理逻辑，即法治是现代化事业的内在构成、法治是实现现代化的外在保障、中国式现代化是法治变革的强大动力。这一法理逻辑，在历史道路上体现为逐层展开的“实践三问”，即要法治还是要人治、走什么样的法治道路、创造什么样的法治形态；在新征程上，要求中国式法治现代化建设从促进和保障社会公平正义、培育中国式现代化的法治有机体、全面推进国家各方面工作法治化等角度持续推进；在价值意蕴上揭示出中国式法治现代化的文明表征，即以幸福生活权彰显人权文明、以法典化彰显制度文明、以法治体系彰显治理文明、以“两个结合”为路径方法推进中华法治文明发展进步。

英文摘要:

Chinese modernization of the rule of law is a symbolic concept formed under the paradigm of the Chinese path to modernization. The interrelationships among the three keywords, i.e., the rule of law, Chinese style, and modernization, deeply embody the legal logic of the concept of Chinese modernization of the rule of law, that is, the rule of law is an internal component of as well as external guarantee for modernization，while the Chinese path to modernization is a powerful force in the reform of the rule of law. This legal logic is reflected in the “three practical questions” that unfold on the historical path, namely whether to choose the rule of law or the rule of man, what kind of path of the rule of law to take, and what kind of form of the rule of law to create. On the new journey, China should continue to advance the Chinese modernization of the rule of law by promoting and safeguarding social fairness and justice, cultivating the legal organism of Chinese modernization, and comprehensively bringing all aspects of state work under the rule of law. In terms of value connotation, the civilization characters of Chinese modernization of the rule of law should be revealed by highlighting human rights civilization with the right to a happy life, highlighting institutional civilization with the codification of laws, highlighting governance civilization with the system of the rule of law, and promoting the development and progress of Chinese rule of law civilization with “two combinations” as the path and method.
