传统的监管体系和监管治理手段，已不能适应数字经济的发展要求。包容审慎监管旨在追求效率与安全的动态平衡，其要求政府给予新业态必要的发展时间与试错空间，并根据公共风险的大小进行适时适度干预，是有利于破解传统监管困局的新型监管模式。数字经济的发展规律和特点，为包容审慎监管的实施带来诸多挑战。包容审慎监管的灵活性与能动性，也易引发监管的不确定性问题。为在法治轨道上推进包容审慎监管的理性实施，面对一时看不准发展趋势的新业态，有必要为市场留足发展空间，通过开放决策程序提升行政理性，引入试验机制促成监管的包容审慎，建立容错机制以激励市场与政府探索创新，完善并加强监督机制以确保行政便宜性与最佳性有机统一。

英文摘要:

The traditional regulatory system and regulatory governance measures can no longer meet the development requirements of the digital economy. Inclusive and prudential regulation pursues a dynamic balance between efficiency and safety. It requires the government to give new business forms the necessary development time and the necessary space for trial and error. The intervene in a timely and appropriate manner in light of the magnitude of the public risks is required as well. It is a new regulatory model conducive to solving the traditional regulatory dilemma. The development laws and characteristics of the digital economy have brought many challenges to the implementation of inclusive and prudential regulation. The flexibility and dynamism of inclusive and prudential regulation can also easily lead to regulatory uncertainty. China should promote the rational implementation of inclusive and prudential regulation on the track of the rule of law. As to new business forms with unclear development trends, it is necessary to leave enough space for the market to develop, improve administrative rationality through open decision-making procedures, introduce an experimental mechanism to facilitate inclusive and prudent regulation, establish a fault-tolerant mechanism to incentivize the market and to promote government exploration and innovation, and strengthen oversight mechanisms to ensure the organic unity of administrative flexibility and optimality.
