事实婚姻在法律性质上原属于不存在的婚姻。20世纪70年代以来，西方国家的法律逐渐开始对事实婚姻予以调整，使同居双方具有一定的权利、义务。我国有关事实婚姻的法律规定有的较为笼统，需要解释，有的存在漏洞需要补充。

英文摘要:

Originally,a de facto marriage is,in its legal nature,a non-existent marriage. Since the 1970s,western countries began to adjust their laws relating to defacto marriage so that the too parties of the cohabitation relationship have certain rights and obligations to each other. Mme of the Chinese legal provisions on de facto marriage are too general and need to be interpreted,while others have loopholes and need to be amended.
